เป็นฐานความผิดอาญา ที่ผู้กระทำ ชำเราบุคคลอื่น ไม่ว่าผู้กระทำหรือผู้ถูกกระทำจะเป็นชายหรือหญิง และจะเป็นคู่สมรสของตนหรือไม่ โดยใช้กำลังประทุษร้าย โดยผู้ถูกกระทำอยู่ในภาวะที่ไม่สามารถขัดขืนได้ หรือโดยทำให้ผู้ถูกกระทำเข้าใจผิดว่าตนเป็นบุคคลอื่น.
(n.) A criminal offense in which the perpetrator has sexual intercourse with another person, regardless of the gender or marital status of either party, by using force or violence, when the victim is unable to resist, or by deceiving the victim into believing the perpetrator is someone else.
